Consideration of the annulment of the previously ratified credentials of the delegation of the Russian Federation (follow-up to paragraph 16 of Resolution 2034/2015 )

1. The Parliamentary Assembly recalls its Resolution 2034 (2015) on the challenge, on substantive grounds, of the still unratified credentials of the delegation of the Russian Federation, adopted on 28 January 2015. In this resolution, the Assembly resolutely condemned the grave violations of international law committed by the Russian Federation with regard to the conflict in eastern Ukraine and the illegal annexation of Crimea.
As a clear expression of its condemnation, the Assembly decided to deprive the Russian delegation to the Assembly of a number of rights for the duration of the 2015 session.
However, for the sole and explicit purpose of maintaining an open and constructive dialogue with the Russian delegation, including on its actions with regard to Ukraine, the Assembly decided to ratify the credentials of the Russian delegation.
At the same time, in paragraph 16 of Resolution 2034 (2015), the Assembly resolved to annul the credentials of the Russian delegation at its June 2015 part-session if no progress had been made with regard to the implementation of the Minsk protocols and memorandum, as well as the demands and recommendations of the Assembly as expressed in that resolution, in particular with regard to the immediate withdrawal of Russian military troops from eastern Ukraine.
2. The Assembly deeply regrets the
manifest lack of progress with regard to the implementation of the
demands made in Resolution
2034 (2015). It equally regrets the decision of the Russian
delegation to suspend all official contacts with the Assembly until
the end of 2015, including all visits on behalf of Assembly bodies.
The Assembly regards this as a clear rejection of its offer to
maintain an open and constructive dialogue, including about Russia’s
action in Ukraine. This raises questions about the Russian
delegation’s commitment to co-operate and to maintain a
constructive dialogue with the Assembly, including on the honouring
of its commitments and obligations to the Council of Europe.
3. The Assembly reiterates its
position and demands with regard to the Russian intervention
resulting in a military conflict in eastern Ukraine, the illegal
annexation of Crimea and the continuing deterioration of the human
rights situation in that region, as expressed in Resolution
1990 (2014) on reconsideration on substantive grounds of the
previously ratified credentials of the Russian Federation and
Resolution
2034 (2015).
In addition, it expresses its serious
concern about, inter alia:
3.1. the harassment and closure of
most non-governmental organisations (NGOs) and media outlets in
Crimea that are critical of Russia’s illegal annexation of the
region, including the Crimean Tatar television station ATR;
3.2. the continued deterioration of
the human rights situation in eastern Ukraine and credible reports
of violations of international human rights and humanitarian law by
all sides in the conflict, including persistent abductions, summary
killings, arbitrary detention and torture of civilians in the areas
under the control of the pro-Russian separatists and Russian troops,
as well as summary killings of Ukrainian soldiers captured by
pro-Russian illegal armed groups;
3.3. the refusal of the Russian
authorities to release Assembly member Nadiia Savchenko and their
decision to prolong her pre-trial detention, despite, inter
alia, her enjoying immunity under the General Agreement on
Privileges and Immunities of the Council of Europe and its Protocol
(ETS Nos. 2 and 10), to which the Russian Federation is a Party;
3.4. the continuing violations, by all
sides, of the ceasefire agreed on in the Package of Measures for the
Implementation of the Minsk Agreements, signed in Minsk on 12
February 2015, and the continuing presence of heavy artillery in the
exclusion zone in violation of these agreements, as well as the
offensives against Debaltseve and Maryinka and the shelling of
Mariupol by illegal armed groups backed by Russian regulars, leading
to considerable numbers of civilian casualties;
3.5. the continuing presence of
Russian troops in eastern Ukraine and the influx of advanced
weaponry and “volunteers” from the Russian Federation;
3.6. the harassment and persecution of
political activists, NGOs and media organisations in Russia who are
critical of Russia’s role in the conflict in eastern Ukraine. In
this context, the recent adoption of the “law on undesirable
foreign organisations” is an additional matter of serious concern.
4. The Assembly is deeply concerned by
the increased harassment and repression of activists and human
rights organisations and the intimidation of dissident voices in
Russia. Through the setting up and the application of a repressive
legal framework, Russian authorities have placed restrictions on
opposition, independent media and civil society, hindering the
freedoms of expression and of assembly. In order to assess the
conformity of these recent developments with Council of Europe
standards, the Assembly encourages the Secretary General of the
Council of Europe to prepare a report on the situation of human
rights and democracy in the Russian Federation.
5. Russia’s illegal annexation of
Crimea and military intervention in eastern Ukraine demonstrate its
clear lack of willingness to honour its accession commitments with
regard to its relations with neighbouring States. The Assembly
therefore calls on the Russian authorities to denounce their claim
of a sphere of special interest with regard to neighbouring States
and to promptly implement the demands of the Assembly expressed in
paragraph 12 of Resolution
2034 (2015).
6. The Assembly remains convinced that
an open dialogue, in good faith, between the Assembly and the
Russian delegation remains important in order to find a lasting
solution, based on international law and principles, to the conflict
in eastern Ukraine and to the illegal annexation of Crimea.
It is now essential that the Russian Parliament and its delegation
to the Assembly express their unequivocal commitment to enter into a
dialogue, without pre-conditions, with the Assembly on Russia’s
compliance with the obligations and honouring of commitments to the
Council of Europe, including with regard to its policy towards
its neighbouring States. The Assembly underscores that the
acceptance of such a dialogue is a basic tenet of membership of the
Parliamentary Assembly incumbent on all delegations. It therefore
calls on the Russian delegation to re-establish dialogue with the
Assembly without further delay, in particular with regard to the
implementation of the demands of the Assembly as expressed in
Resolution
1990 (2014) and Resolution
2034 (2015) as well as in this resolution.
In this respect, as a first step,
the Russian delegation should return to the work of the Committee on
the Honouring of Obligations and Commitments by Member States of the
Council of Europe (Monitoring Committee) and allow this committee’s
rapporteurs for the Russian Federation to go to the country in the
context of their work. In addition, the Russian authorities, as the
occupying power, should facilitate a joint visit to Crimea of the
co-rapporteurs for Ukraine and for the Russian Federation to take
stock of the human rights situation in this region.
7. The Assembly deplores the decision
by the Russian authorities to blacklist 89 European personalities
from entering the Russian Federation. The Assembly condemns the fact
that this list contains the names of a current and a former member
of the Parliamentary Assembly, who have been included solely because
of positions they have taken in the Assembly with regard to Russia’s
illegal annexation of Crimea and its military intervention in
eastern Ukraine. This is completely unacceptable.
8. In addition, the Assembly calls
upon the Russian authorities to:
8.1. fully implement the Minsk
Agreements and the Package of Measures for the Implementation of the
Minsk Agreements, to which the Russian Federation is a Party, and
use its influence on the pro-Russian illegal armed groups to do the
same;
8.2. immediately reverse the illegal
annexation of Crimea;
8.3. withdraw all its troops from
Ukrainian territory;
8.4. immediately release Nadiia
Savchenko and allow her to return to Ukraine;
8.5. release all captives, in
particular civilians and including captives held in the Russian
Federation, and to use its influence on the pro-Russian illegal
armed groups to do the same;
8.6. cease the harassment and
prosecution of citizens, activists, NGOs and media organisations in
the Russian Federation that are critical of the Russian Federation’s
role in Ukraine;
8.7. bring the law on foreign agents
fully into line with European standards and principles;
8.8. provide the public with accurate
information about the participation of forces of the regular Russian
army in the military conflict in Ukraine;
8.9. fully respect the rights to
freedom of assembly and expression, including of those critical of
the authorities’ policies;
8.10. provide the families of missing
Russian soldiers with information on the fate of their missing
relatives.
9. As a signal of its commitment to
an open and constructive dialogue with the Russian delegation, the
Assembly, while noting the sanctions currently in place, resolves
not to annul, at this time, the already ratified credentials of the
Russian delegation.

The Parliamentary Assembly is seriously concerned about the growing
number of cases of missing persons reported in the areas of military
action in certain areas of the Donetsk and Luhansk regions of
Ukraine, as well as in occupied Crimea.
2. Since the beginning of the
Russian aggression in Ukraine, in early 2014, more than 1 300
persons have been reported missing. This figure, which only
takes into account data collected by the Ukrainian authorities, is
in reality certainly higher. Among the missing persons are not only
soldiers, but also civilians, including volunteers who were helping
victims of the conflict. Their fate and whereabouts are unknown and
difficult to determine as their most likely location is in the
territory which remains under the control of separatist groups.
3. The Assembly welcomes the efforts
undertaken by the Ukrainian authorities with a view to determining
the fate and whereabouts of missing persons. In particular, it
commends the establishment of an Interagency Centre for Assistance
in the Release of Captives and Hostages and the Search for Missing
Persons under the responsibility of the State Security Service of
Ukraine and the creation of a unified register of pretrial
investigations (including a database of DNA samples of unidentified
bodies and the relatives of missing persons) within the Ministry of
Internal Affairs, which have significantly facilitated the
identification procedure of missing persons.
4. The Assembly deplores the decision
of the President of the Russian Federation to classify information
on casualties among the personnel of the Armed Forces of the Russian
Federation incurred in special operations during peacetime.
5. At the same time, however, the
Assembly considers that the issue of missing persons requires a more
comprehensive approach at governmental level and should include the
co-ordination of the work of various volunteer and human rights
organisations with regard to tracing and collecting information on
missing persons. Furthermore, the medical, social and financial
assistance offered to the families of missing persons is largely
insufficient.
6. The Assembly emphasises that the
problem of missing persons can only be solved through the joint
efforts of all sides of the conflict. The Assembly therefore urges
Ukraine, the Russian Federation and the separatist groups
controlling the occupied territories of Donetsk and Luhansk region
to:
6.1. provide an efficient response, in
terms of investigation and support for families, to all reported
cases of missing persons, in compliance with international
humanitarian law;
6.2. share information on the fate and
whereabouts of missing persons and return unidentified bodies, where
appropriate, to the respective sides of the conflict;
6.3. establish a joint mechanism
(working group) to deal with the issue of missing persons, and
ensure its functioning, with a view to:
6.3.1. collecting and processing
information on missing persons;
6.3.2. creating a consolidated list of
missing persons;
6.3.3. introducing effective measures
enabling tracing, recovery and identification of the human remains;
6.3.4. ensuring access to burial
places;
6.3.5. providing exhaustive
information to the relatives of missing persons on the progress on
their cases;
6.3.6. involving and co-ordinating
action of non-governmental and volunteer organisations dealing with
tracing missing persons;
6.4. systematically collect post
mortem data from unidentified bodies, as well as DNA samples from
the families of missing persons;
6.5. accelerate the process of
identification of exhumed bodies using all available means,
including DNA matching, the matching of ante and post mortem data
and visual identification, as determined by forensic experts;
6.6. provide financial, medical and
social assistance to the families of missing persons;
6.7. facilitate access and the work of
civil society and international humanitarian organisations tracing
missing persons;
6.8. encourage the mass media to
attract public attention to the problem of missing persons.
7. The Assembly further urges the
Ukrainian authorities to:
7.1. create a dedicated governmental
mechanism, tasked with the co-ordination of the work of all
governmental and non-governmental bodies working on the issue of
missing persons, and in particular to:
7.1.1. ensure sufficient budgetary
funds for its functioning;
7.1.2. create and maintain a unified
data register with regard to missing persons during the conflict in
Ukraine;
7.1.3. provide adequate funding for
tracing operations;
7.1.4. elaborate a mechanism of State
compensation and support to the families of missing persons and
ensure that the families concerned are informed about the existence
of this mechanism;
7.1.5. include in its work
non-governmental organisations, volunteer associations and
representatives of the families of missing persons;
7.2. introduce into the legislation a
provision ensuring the right of families to know what has happened
to relatives who remain unaccounted for in connection with armed
conflicts and internal violence, in compliance with the relevant
provisions of international humanitarian law;
7.3. strengthen legal measures dealing
with the problem of missing person, in particular to consider the
adoption of a specific law on missing persons which would introduce
a legal status of “missing” and “war victim”, allowing the
families concerned to benefit from financial, social and legal
assistance, including a mechanism of State compensation;
7.4. address the needs of single heads
of families of missing persons, taking into consideration specific
needs of women and children;
7.5. further develop national
capacities specialised in forensic and tracing expertise and
encourage them to assimilate the experience of the International
Committee of the Red Cross (ICRC) in this respect;
7.6. provide adequate legal and
awareness-raising training for all officials concerned with regard
to the implementation of legal provisions and administrative
procedures when addressing the rights of the families of missing
persons.
8. The Assembly urges the separatist
groups which control the occupied territories in the Donetsk and
Luhansk regions to:
8.1. release all captured prisoners
and hostages;
8.2. engage effectively with the work
of appropriate working subgroups of the Trilateral Contact Group in
accordance with the Minsk agreements, with a view to dealing with
the issues of captured and missing persons and identifying possible
grave sites;
8.3. grant access for international
humanitarian missions to places of detention of prisoners.
9. The Assembly further urges the
authorities of the Russian Federation to:
9.1. release all prisoners illegally
captured in Ukrainian territory;
9.2. conduct an effective
investigation and prosecute perpetrators in cases of abduction,
enforced disappearances, torture and politically motivated killings
of Ukrainian activists and members of the Crimean Tatar community;
9.3. exercise pressure over the
separatist groups which control the occupied territories in the
Donetsk and Luhansk regions for the immediate release of all
civilians held in custody on the territory under their control and
for the exchange of prisoners;
9.4. create a national mechanism to
deal with the issues of captured and missing persons during the
conflict in Ukraine;
9.5. provide the families of missing
Russian soldiers with accurate information on the fate and
whereabouts of their missing relatives;
9.6. immediately grant access to the
territory of occupied Crimea to international human rights
monitoring missions.
10. The Assembly also calls on the
member States to provide:
10.1. financial and technical
assistance to the Ukrainian authorities responsible for exhumation
and the identification process;
10.2. necessary assistance to deal
with the psychological effects on the families of missing persons;
10.3. financial assistance to the
associations of families of missing persons and non-governmental
organisations tracing missing persons.
11. The Assembly encourages the
International Committee of the Red Cross (ICRC) to make available
their expertise to Ukrainian institutions, in particular in:
11.1. training national specialists in
the documentation of missing cases, the consolidation of lists and
the assessment of and response to the needs of the families;
11.2. providing technical assistance,
in particular in setting up the DNA laboratory in Dnipropetrovsk and
supplying reagents for the DNA tests;
11.3. informing the Ukrainian
population about the main aspects of international humanitarian law.
12. The Assembly invites the Council
of Europe Commissioner for Human Rights to follow the problem of the
missing persons during the conflict in Ukraine.

Missing persons during the conflict in Ukraine
1. The Parliamentary Assembly refers to its Resolution 2067 (2015) on missing persons during the conflict in Ukraine.
2. The Assembly stresses that the
issue of missing persons in Ukraine is a serious European problem
which may hinder the prospects for a peaceful settlement in the
region and have negative consequences on the process of
reconciliation.
3. The Assembly therefore recommends
that the Committee of Ministers identify possible contributions by
the Council of Europe to the ongoing process of clarifying the fate
and whereabouts of missing persons in connection with the conflict
in Ukraine, and offer relevant expertise, especially in the
framework of co-operation programmes.

на резолюцията за обявяване на Русия
за агресор, ПАСЕ „погази всички
международни актове за защита на
мира и безопасността на човечеството“,
заяви пред журналисти ръководителят
на комитета на Държавната дума по
сигурността Ирина Яровая.
„Сама по себе си резолюцията на ПАСЕ
може да се разглежда като хуманитарна
катастрофа“, добави тя.Според нея, преди „умишлено и неоснователно да обвиняват Русия, която фактически единствена оказва хуманитарна помощ на жителите на Донбас, и да отказват на жителите на Крим от право на живот, би било добре представители на ПАСЕ да посетят поне Ростовска област или Крим, и да поговорят с украинските бежанци, за да си изяснят какво се случва всъщност, да научат за реалните престъпления, извършвани от властите в Киев срещу мирни жители, жени и деца“.
Яровая припомни, че вчера ПАСЕ с мнозинство гласове прие резолюция, обвиняваща Русия в агресия.
РУСКАТА АГРЕСИЯ В УКРАЙНА ОФИЦИАЛНО ПРИЗНАТА ОТ ПАСЕ

Постоянната парламентарна делегация на Украйна в ПАСЕ е успяла да постигне внасянето на поправки в резолюцията приета от асамблеята. Ирина Геращенко член на постоянната делегация заяви, че представителите на Украйна са настоявали към работата по темата да бъде привлечен Международният комитет на Червения кръст. Организацията от своя страна е заявила готовност за съдействие.
Резолюцията приета от ПАСЕ е първият официален документ, в който фигурират думите „руска агресия в Украйна“. В него се призовава Русия и сепаратиските групи, които са окупирали територии в Донецка и Луганска област да освободят всички пленници и заложници.
От Белия дом съобщиха, че по инициатива от руска страна се е състоял разговор между американския президент Барак Обама и руския му колега Владимир Путин, това е първият разговор между двамата от февруари месец насам. Обама е призовал да бъдат изтеглени войските и военната техника от територията на Украйна.
